Colorado Targets AI Developers in Ambitious Legislation

Artificial intelligence (AI) regulations have been one of the most discussed and debated topics in state houses across the United States. Colorado’s newest AI bill, CO SB 205, goes further than legislation passed by other states. 


Previous state bills focused on regulating AI have primarily targeted the outputs of generative AI software - such as deepfakes (images and videos that mimic real people ), or restricted its use in certain industries and settings, such as recruiting practices and in TV and film.


However, the Colorado bill goes further in targeting AI developers, requiring them to use “reasonable care” in protecting consumer data and implementing safeguards to protect against discrimination.


Currently, the legislation only targets companies deploying AI software with more than 50 employees but does not go into effect until February 2026.


This time horizon provides stakeholders and legislators the opportunity to make significant changes before many of the key provisions go into effect.
